1. Introduction

(a) Website Owner. CLEAN HEALTHY BODY LLC (“CHB,” “we,” or “us”) is the owner of this website (the “CHB Website”). CHB can be contacted by e-mail at info@cleanhealthybody.com. This Privacy Policy discloses CHB information practices for the CHB Website, including what type of personal identifiable information is requested in order to make a purchase, how the information is used, and with whom the information is shared. 

(b) Website Visits. CHB collects certain information from CHB Website visitors. This includes, but is not limited to, IP address, e-mail address, type of computer and web browser, what pages visitor accessed, and limited information about search requests. This information is used to solve technical problems and to calculate overall usage statistics.

(c) Website Transactions. At times, CHB will need personal information regarding a customer. For example, to process an order or provide a subscription, CHB may need to know your name, mailing address, e-mail address, and credit card details. It is CHB’s intent to inform you before CHB collects personal information, such as your name and/or address on the Internet. If you tell us that you do not wish to have this information used as a basis for further contact with you, CHB will respect your wishes.

2. Personal Information That May Be Collected

(a) Identifying Information. In order to make a purchase, CHB will request you to provide certain personal identifying information, which may include: name, postal address, e-mail address, screen name, password, telephone number, method of payment, and, if applicable, credit card number. CHB may request additional information necessary to establish and maintain your account.

(b) Information from Children. CHB does not collect or maintain information from users actually known to be under the age of 13, and no part of the CHB Website is structured to attract anyone under the age of 13.

(c) Testimonials. If you participate in a CHB testimonial, you should be aware that the information disclosed and shared will be broadly available to other persons, both inside of and/or outside CHB. Some individual CHB chat rooms, forums or bulletin boards have additional rules and conditions regarding participation. Prior to posting a testimonial, we will obtain your consent to use your name and the content of the testimonial. If you wish to update, or delete your testimonial, please contact us at info@cleanhealthybody.com and include your name, testimonial location, and contact information Also, any opinion expressed in a testimonial is your own and should not be considered as reflecting the opinion of CHB.

(d) Links to Other Websites. The CHB Website may contain links to other websites. CHB is not responsible for the privacy practices or the content of those other websites.

3. Uses Made of the Information

(a) Stored Information Uses. CHB stores the information you provide. Stored information is used by CHB, its agents, and its third-party vendors: to support customer interaction with the CHB Website; to deliver customer purchases; and/or to contact customer again about other CHB services and products.

(b) Marketing Uses. Unless you unsubscribe via the link provided in marketing emails or opt-out by the email process described in this Privacy Policy, CHB reserves the right to provide a customer with information about the CHB Website, CHB products and services, and related information in which the customer has indicated an interest.

(c) Online Advertising. Some companies that help CHB deliver interactive on-line advertising, such as banner ads, may collect and use information about CHB’s customers to help CHB better understand the types of advertising or promotions that are most appealing to CHB’s customers. CHB does not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way.

For example, CHB uses Google DoubleClick DART cookies. Google is a third-party vendor on the CHB Website and uses cookies, known as DART cookies, to serve ads to our site visitors based upon their visit to www.cleanhealthybody.com and other sites on the Internet. Visitors may choose to decline the use of DART cookies by visiting the Google advertising Privacy Policy at the following URL:  https://policies.google.com/technologies/ads. 

You may also opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”), which may include third parties used by CHB, on the NAI’s website.

(d) Limited Uses Identified. Personal information collected by CHB will be used by CHB for the purposes discussed throughout this Privacy Policy and for additional purposes, including: 

(i) To Request Feedback. CHB may use your information to contact you about your use of the CHB Website.

(ii) To Send Administrative Information. CHB may use your personal information to send you information about changes to our terms, conditions, and policies. 

(iii) To Protect Our Services. We may use your personal information as part of an effort to keep the CHB Website safe and secure (e.g., fraud monitoring and prevention). 

(iv) To Administer Prize Draws and Competitions. When you elect to participate in our competitions, we may use your information to administer prize draws and competitions. 

(v) To Offer Support to Users. We may use your information to respond to your inquires and solve potential issues you might have with the use of our products or services.  

4. Disclosure of the Information

(a) Agents and Third Parties. CHB employs or engages other companies and individuals to perform business functions on behalf of CHB. These persons and companies are provided with personal identifying information required to perform their functions. These persons and companies engage in a variety of functions which include, but are not limited to, fulfilling orders, delivering packages, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments, and providing other services to customers.

(b) Mergers and Acquisitions. In the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of CHB's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, personal information held by CHB about its users may be among the assets transferred to a buyer or other successor in.

(c) Disclosure to Governmental Authorities. CHB releases personal identifying information when CHB believes release is appropriate to comply with law, to enforce CHB agreements, or to protect the rights, property, or safety of CHB customers. CHB may also release such information in an exchange of information with other companies and/or organizations for the purposes of fraud protection and credit risk reduction.

5. Use of Computer Tracking Technologies

(a) No Tracking of Personal Information. The CHB Website is not set up to track, collect or distribute personal information not entered by visitors. Our site logs do generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff, including those of third-party vendors, to provide better services to the public and may also be provided to others, but, again, the statistics contain no personal information and cannot be used to gather such information.

(b) Use of Cookies. CHB and its third-party vendors collect non-identifiable and personal information through the use of various technologies, including “cookies.” A cookie is an alphanumeric identifier that a website can transfer to customer’s hard drive through customer’s browser. The cookie is then stored on customer’s computer as an anonymous tag that identifies the customer’s computer, but not the customer. Cookies may be sent by CHB or its third-party vendors. You can set your browser to notify you before a cookie is received, giving an opportunity to decide whether to accept the cookie. You may also set its browser to turn off cookies; however, the CHB website and other websites may not then work properly.

(c) Use of Web Beacon Technologies. CHB may also use Web beacon or other technologies to better tailor the CHB Website to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the CHB Website, a non-identifiable notice of that visit is generated which may be processed by CHB or by its suppliers. Web beacons usually work in conjunction with cookies. If you do not want cookie information to be associated with your visits to these pages, you can set your browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.

(d) Collection of Non-Identifiable Information. CHB may collect non-identifiable information from user visits to the CHB Website in order to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on the CHB Website; website and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” CHB or its contractors may use this data to analyze trends and statistics.

(e) Collection of Personal Information. CHB collects personal identifying information from customer during a transaction. CHB may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help CHB understand trends and patterns. This information is not reviewed at an individual level.

6. Information Security

(a) Commitment to Online Security. CHB intends to protect customer personal information and to maintain its quality. To achieve information security and quality, CHB implements appropriate measures and processes, such as using encryption when transmitting certain sensitive information. 

The safety and security of your information also depends on you. If you have a password for access to certain parts of the CHB Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Internet like message boards or social media, including outside of the CHB Website. The information you share in public areas may be viewed by any Internet user.

(b) No Liability for Acts of Third Parties. CHB will exercise reasonable efforts to safeguard the confidentiality of customer personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, CHB shall not be liable for unauthorized disclosure of personal information due to no fault of CHB including, but not limited to, errors in transmission and unauthorized acts of CHB staff and third parties.

7. Privacy Policy Changes and Opt-Out

(a) Changes to Privacy Policy. This Privacy Policy was last updated on __, 2023. CHB reserves the right to update its Privacy Policy statement at any time. CHB will notify you of any material change by email (sent to the email address specified in your account) or by means of a notice on the CHB Website prior to the change becoming effective. We encourage you to periodically review this Policy for the latest information on our privacy practices.

(b) Opt-Out. A customer at any time may opt out of further collection, use, or disclosure of personal information by CHB. You may exercise this opt-out by contacting CHB via e-mail at info@cleanhealthybody.com. After processing the opt-out, CHB will delete your personal information from its database except for information provided to CHB as a result of a product purchase, warranty registration, product service experience, or other transaction that requires CHB to maintain a record.

As discussed above, CHB uses third-party vendors who may have their own independent opt-out processes.

8. Access to Data

(a) Information Maintained by CHB. CHB will provide you with access to the following personally identifiable information: Name, Email, Phone Number, and Address for the limited purpose of viewing. To view this information, go to the account page of the CHB Website and enter your login information.

(b) Corrections and Changes to Personal Information. Help CHB to keep customer personal information accurate. If your personal information changes, or if you note an error upon review of customer information that CHB has on file, please promptly update your profile or e-mail CHB at info@cleanhealthybody.com to provide the new or correct information.

9. Accountability

(a) Questions, Problems and Complaints. If you have a question about this Policy statement, or a complaint about CHB’s compliance with this Privacy Policy, you may contact CHB by e-mail at info@cleanhealthybody.com. 

(b) Terms of Use. By continuing to use the CHB Website, you are accepting CHB’s practices described in this Privacy Policy. Any dispute over privacy between a customer and CHB is subject to the provisions of this notice and to CHB’s Terms of Use Agreement which is hereby incorporated herein and which can be found at:  https://cleanhealthybody.com/terms-and-conditions.

10. Other Information

(a) HIPAA. CHB is not an entity that is covered by HIPAA. The HIPAA privacy rules apply to health plans, health care clearinghouses, to any health care provider who transmits health information in electronic form in connection with transactions for which the Secretary of HHS has adopted standards under HIPAA (the “covered entities”) and their service providers (“business associates”). This means that the information that you provide to CHB is not protected by the HIPAA privacy rules and regulations.

(b) California Residents. This notice section applies to California residents and supplements the Privacy Policy. California residents may request certain information regarding CHB’s disclosure of personal information for their direct marketing purposes. To make such a request, please write to: info@cleanhealthybody.com. Within 30 days of receiving such a request, CHB will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. CHB reserves its right not to respond to requests submitted other than to the address specified in this paragraph.

(c) A Note to Users Outside of the United States. This site is intended to facilitate the sale of goods and services to residents in the United States. If you are a non-U.S. user of the CHB Website, by visiting the CHB Website and providing us with data, you acknowledge and agree that your personal information may be processed for the purposes identified in the Privacy Policy. In addition, your personal information may be processed in the country in which it was collected and in other countries, including the United States where laws regarding processing of personal information may be less stringent than the laws in your country and where your personal information may be accessed by the courts, law enforcement and national security authorities as required under the laws of those jurisdictions. By providing your data, you consent to such transfer.
